The session explored questions about the potential post-Brexit regulatory environment with particular reference to cross-border trading and Immigration/work permits. The business immigration team, who advises and represents many of OTS Solicitors’ business clients provided detailed information on:

The focus of the talk then shifted onto the effect of Brexit on business. OTS Solicitors' stated that among the many impacts of Brexit, businesses in the Britain might experience:

  • A shortage of available workers, both skilled and unskilled
  • Increased costs related to recruiting talent
  • Difficulty retaining EU workers who may return home due to what is perceived by many as a hostile environment towards EU nationals

OTS Immigration solicitors went on to point out the possibility that UK employers may be able to employ highly-skilled migrants under a points-based system, like the one in place for recruiting talent from outside the EU. However, this would fail to help employers in industries who rely on low-skilled workers, for example, the agriculture and hospitality sectors. This is because low-skilled workers often fail to meet the English-language requirement and employers have to undertake a strict Resident Labour Market Test to ensure no ‘settled’ UK workers can fill the position.

The criteria for obtaining a Tier 2 and 5 Sponsor Licence were also illustrated by the business immigration lawyers at OTS Solicitors.

“This event was crucial for UK businesses. Many sectors are heavily reliant on EU nationals for labour, and talent from the Eastern European countries are in high demand thanks to their excellent education systems. We are already seeing a drop in the number of Eastern European workers coming to the UK. Businesses need support and knowledge to ensure they have the ability to attract and retain talent during Brexit negotiations and after the UK leaves the EU in 2019.”
