In the case of – Sala (EFMs: Right of Appeal) [2016] EFM’s, the judge in the Upper Tribunal did hold that extended family members of EEA nationals do not generally enjoy a right to appeal to the tribunal if the Home Office refuse their application for a Residence Card (or other documentation such as a Family Permit or Registration Card).
