Which country should I apply for divorce in?
Im married since 4 years with my husband, we both have a settled status in UK, Im Italian and hes nigerian and we have a 18 months old daughter born in the UK. We also have residence in Italy since 2020, where we own a house. All of us 3 are resident boh in uk and Italy. I want to separate and I spent the last 4 months in Italy with our daughter with his permission after discovering multiple cheatings from him. Can I apply to court in Italy or UK? The baby has spent more time in Italy than the Uk since she was born in March 2022. How can I proceed?

As you and your partner have residence in the UK and Italy, you would be able to apply in either country for divorce. However, as you and the child are currently in Italy, if you wished to make any children applications, this would have to be in Italy unless you both relocate to the UK, then the application can be submitted here.
