The advantages of the merit-based EB1 Green Card
The EB1 is a merit-based Green Card that provides permanent residency for professionals looking to relocate to and work in the United States.
The three advantages are:
- It is flexible as it is self-certifying. Applicants do not require sponsorship from a US employer.
- Applicants do not need labor certification.
- It is fast because premium 15-calendar-day processing is available.
The three routes to the EB1 Visa
There are three categories within the EB1 Green Card route:
- EB-1A for individuals with extraordinary ability in the arts, business, sciences, education, or athletics.
- EB-1B for outstanding professors and researchers.
- EB-1C for multinational executives and managers.
EB-1A for those with extraordinary ability
USCIS requires evidence of extraordinary ability, as demonstrated through either national or international recognition. Additionally, applicants must demonstrate how their work will benefit the United States.
The easiest way to prove ability is through the achievement of an internationally recognised award, such as an Oscar or a Nobel Prize.
If an applicant isn’t a major prize winner, they need to meet at least three of these eligibility criteria:
- Evidence of receipt of lesser nationally or internationally recognised prizes or awards for excellence, or
- Evidence of a performance in a leading or critical role in distinguished organisations, or
- Evidence of commanding a high salary or other significantly high remuneration in relation to others in the field, or
- Evidence of membership in associations in the field that require outstanding achievement from their members, or
- Evidence of published material about themselves in professional or major trade publications or other major media, or
- Evidence that they have been asked to judge the work of others. This can be as part of a panel of judges or individually, or
- Evidence of original scientific, scholarly, artistic, athletic, or business-related contributions of major significance to the field, or
- Evidence of authorship of scholarly articles in professional or major trade publications or other major media, or
- Evidence that their work has been displayed at artistic exhibitions or showcases, or
- Evidence of commercial successes in the performing arts.
Applying for the EB1 Green Card
The EB1 Green Card application process involves five stages:
- File Form I-140 (Immigrant Petition for Alien Worker)and supporting documents with USCIS.
- USCIS reviews the filing and may consider the need for additional paperwork, and therefore, issue a Request for Evidence (RFE).
- USCIS approves the I-140 petition.
- Application made for Adjustment of Status using Form I-485, where the applicant is in the United States. If not, the applicant applies through consular processing.
- If the adjustment of status is approved, the applicant receives their Green Card and becomes a permanent resident.
Evidence for an EB1 Green Card
As an applicant for an EB1 Green Card does not require a sponsor; they have to file their own 1-140 petition and supporting documents. US Immigration Lawyers say that most petitions that fail do so because the applicant does not file sufficient evidence in support, or the evidence is not of high enough quality. An experienced U.S. Attorney with expertise in EB-1 Green Card applications can help an applicant secure their Green Card with minimal fuss.
The mistake made by many professionals applying for an EB1 Green Card is assuming that their professionalism and expertise are self-evident. That’s understandable when a person has a high profile and excellent reputation in their specialised field, but USCIS caseworkers don’t know the applicant or their reputation and will need convincing. A well-written petition and statement are not sufficient.
