US Immigration Lawyers Welcome Reports That Donald Trump Favours H1B Visas
Many US Immigration Lawyers have raised concerns about the ease of securing Work Visas or Business Visas after Donald Trump begins his second term as president in the US.
Fears have eased because papers like the New York Post and the UK Times report that the new president supports the H1B Visa. Historically, that hasn’t always been the case.
If you are contemplating making a H1B Visa application our H1B Visa Solicitors can help you whether you are based in the UK or elsewhere.

H1B Visas are a ‘great programme’
As experienced US Immigration Attorneys we think that H1B Visas are great but our views aren’t important. What’s important is the US government's likely approach to the H1B Visa programme.
In the reported words of Mr Trump:
‘’I have many H1B Visas on my properties. I've been a believer in H1B. I have used it many times. It’s a great programme.’
When the UK Times and Reuters quote that Donald Trump is in favour of the H1B Visa it offers some comfort to potential visa applicants. After all, newspaper reporters are now saying that Mr Trump is favouring Elon Musk and supportive of the need for highly skilled non-US workers to work in US tech companies. These workers predominantly come from India but Silicon Valley is always keen to hire the brightest and best from across the globe.
Remembering the 2016 commitment to end the H1B Visa programme
Some specialist visa US legal services remember Donald Trump's commitment to end the H1B Visa programme. That was back in 2016. Could his view change back to the 2016 stance? There is a lot of pressure from US voters to reduce net migration.
Just like in the UK and elsewhere, it can be a hard message to sell the idea that your country needs overseas workers to come in and take highly paid and skilled jobs. Many voters struggle with the idea that any immigration can be good for the country and bring real benefits to the US.
US immigration law firms find it easy to see why Silicon Valley entrepreneurs need the brightest and best skilled workers and why it is equally good for the US to attract innovators and investors to start up new companies or grow existing ones on E2 Visas. It is a harder sell if you are a Trump voter at risk of job loss to see how inviting any overseas workers and entrepreneurs will ultimately generate wealth and create jobs for existing US workers.
Planning for change
It is hard to know whether the new Trump administration will make substantial changes to the H1B Visa. We have had welcome assurances but whilst the tech giants have enormous influence it is equally clear that those at risk of job losses won't necessarily distinguish between highly skilled workers and entrepreneurs and those crossing borders desperate to start a new life in the US.
Where does that leave H1B Visa applicants in 2025? Our view as US Immigration Lawyers in the UK remains that H1B Visa applicants need to be ready in case of:
- Changes to the specialty occupations for H1B Visas
- Tightening of the rules
- Potential for increased numbers of H1B Visa refusals and toughening the rules on Green Cards
Looking at the statistics, in 2019, during the Trump first administration, H1B Visa applications had a refusal rate of around 21%. During Biden’s term in office, the refusal rate dropped to around 4%. It will be interesting to see what the statistics reveal in 2026 and beyond.
Getting ahead with your H1B Visa application
If you are a skilled worker looking to relocate to the US with your family on a H1B Visa our US Visa Lawyers in London still recommend that you go ahead with your application as soon as you can do so. That’s because, striking a middle ground and to keep tech giants and millions of grassroots supporters happy, the H1B Visa immigration rules may be tweaked to make it harder to get a visa if you are not the very brightest and best. Being realistic, many H1B Visa applicants are at the start of their professional careers and that’s why they are prepared to move from countries like the UK, Ireland and India to start a new life and career in the US. If that sounds like your situation we recommend that you go ahead with your H1B Visa application now.
