Can periods of absence due to Covid19 be waived for the purposes of continuous residence?

  • Posted on

I've been in the UK since 2015 for my studies (2015-2018) and then immediately started work in London from 2018 until today. I was also studying in London part-time from 2019 to summer 2021 (2 years). However, in between I had to return home from March 2020 to July 2021 due to COVID (although I was still studying remotely, but not working during this period). Can these days being away be considered as extenuating circumstance due to COVID and be waived?

Thank you for your enquiry.

The Home Office guidance states that they may discount periods of extended absence if you are able to show evidence of inability to return to the UK. The guidance is discretionary and it would depend on your individual circumstances. For more information, please contact us on 02039599123.
