Our EEA PR application has been refused in 2016 and we have appealed. The application has been refused on the ground that "we are not financially dependent on our son". The last line of the decision states that "As a EU national you are not required to leave the United Kingdom as a result of this decision".Hence my question is If in case our appeal is also refused, will it effect our residency rights in UK and will we be able to apply for "settled status" on our own accord under the new system which the government will be bringing in to force in 2018 for EU nationals living in UK after BREXIT. Will our application for "settled status" be prejudiced because of PR refusal or losing the appeal.
