What happens if I break my continuous residence for ILR?

  • Posted on

I am a foreign doctor living in the UK and working for NHS on Tier 2 visa. I work less than full time but meet the income criteria for my visa. I want to get ILR once I have been here 5 years. I read some guidance for ILR applications on the uk.gov website that worries me that if I work outside the UK at all, even while fulfilling my NHS contract, that would break the continuous residence requirement. Could you give advice as to the impact on an ILR application of work outside the UK while still fulfilling all duties for a UK based job that is providing a visa?

Thank you for your enquiry.

Usually you can make your application within 28 days of the time period i.e. 5 years. You would need to be careful not to break the continuous residence requirement by spending extended periods overseas.  For more information, please contact us on 02039599123.
