Frequently Asked Questions on Indefinite Leave to Remain
Is ILR the same as citizenship?
Settling in the UK can be a confusing term. It covers ILR and citizenship, but the two are different. With ILR, you no longer need to apply for visas and you are free of immigration control. However, you are not a British citizen and you retain your nationality. If you want to do so, you can apply for British citizenship after you have had Indefinite Leave to Remain for at least 12 months. Getting British citizenship doesn’t necessarily mean you will have to lose your nationality, as your home country may allow you to have dual nationality. With dual nationality, you are a British citizen and retain your nationality of origin.
If I get ILR, will my family automatically get ILR as well?
If family members, such as a husband or wife or dependent children, came to the UK with you, then they will each need to make a settlement application when they meet the ILR eligibility criteria. They won't automatically get ILR because you made a successful application. Our ILR Solicitors offer ILR assistance for families. For example, the minimum income requirement for a Spouse Visa or Unmarried Partner Visa to ILR is currently £29,000 (unless transitional rules apply) but the income threshold when switching from a Skilled Worker Visa to ILR is currently the higher of £38,700 or the ‘standard going rate’ for the type of work you are doing. There are complex rules on circumstances where the minimum income requirement can be reduced or what capital or income can be combined to help you meet the threshold.
