Why choose international surrogacy?

You may want to adopt or to find a UK surrogate but both options can be hard because there are few young children available for adoption and it is just as difficult to find a UK surrogate.

Other countries have encouraged surrogacy as a route to parenthood and that’s why many couples investigate international surrogacy. You may want to choose a country where surrogacy is relatively common or opt to use a country where you have historical links. For example, the US is widely known for its established surrogacy framework although US surrogacy laws depend on the State where your surrogate lives. If you are choosing an overseas country based on a personal connection or for heritage reasons it is essential to get the latest advice on surrogacy law in that country.

Bringing your child to the UK

It is important to take detailed legal advice in advance of committing to the surrogacy arrangement so you are not surprised by the process or timescale. There is nothing worse than welcoming a baby into the world and then being frustrated by the process you need to follow with the Home Office to get your baby a British passport or to get your child back to the UK so you can sort out British citizenship for them if they didn't acquire that at birth.

The UK entry clearance process will depend on the country you choose for international surrogacy. For example, if you choose the US, your child is a US citizen at birth and can get a US passport. The child should not enter the UK without a valid visa. In other countries, your child will need to wait for a British passport and the relevant visa.

Legal parenthood

Most children born through international surrogacy arrangements are made the subject of parental orders once they are in the UK. This order is normally necessary to confer the legal status of parents on the parents. Without the order, the surrogate mother (and potentially her spouse) might remain your child’s parents under UK law.
