Hello, I am excising my break clause to end my tenancy earlier and I am in disagreement with my landlord on pro rata calculation. I want to use the monthly rent for the month, divided by the days in the month as daily cost for days I am staying in the final period, but the landlord wants to use annual rent /365 as daily cost. Landlord's method will result in higher charge. My contract says "£xxx per calendar month. payable monthly in advance on or before 26th day of each and every month of the Tenancy.” So I believe, it should be pro rata based on monthly rent. Contract doesn't has specification on how pro rata should be calculated. Is there any legal sounding in my calculation and can I enforce him to use mine? Thanks.
