In 2016 My Partner Entered Into Tenancy Agreement For Private Rental Home Not Business In The Name

  • Posted on

In 2016 my partner entered into a tenancy agreement for a private rental (home not business) in the name of the ltd company he had at the time. This was therefore a company let agreement. The company was dissolved in 2020 (due to inactivity) and the letting agents were verbally informed. We heard nothing until now when we are being advised that the deposit we placed will be transferred back to the company (that no longer exists) and we need to form a new tenancy agreement and provide a new deposit. The payment for the rent was initially paid from the business account but changed to my partners personal account when the company was dissolved. This was never queried. My partner was sole director of the company. Where do we stand with the deposit?
