We are 9 months into a 3 year rental contract with a 2 year break clause. We have recently learned that there is extensive construction work due to take place for 23 months (building another two levels of flats directly above us), beginning in September, which we were not told about when signing the lease. I have contacted the council and confirmed that the landlord would have been aware of this as they consulted in 2018 about the work. Since we are working from home for the foreseeable future this will have a significant impact on us and our daily lives, and we would not have signed a 3 year lease had we been told this from the beginning. Are we entitled to end the tenancy early on these grounds and if so, would we still be entitled to our deposit in full?
